If you do not agree with any part of these terms, refrain from using our services.

1. Introduction

Upclass.ai provides secure video encryption services for educators ("Instructors") and students ("Users") to prevent unauthorized sharing and piracy. These terms apply to all users, including instructors who upload content and students who access the encrypted educational material.

2. Acceptance of Terms

By creating an account or accessing Upclass.ai's services, both instructors and students agree to comply with and be bound by these terms, along with our Privacy Policy. Upclass.ai reserves the right to modify these terms at any time, and continued use of our services implies acceptance of the updated terms.

3. Eligibility and Registration

• Instructors: Only legally registered individuals or organizations can create an account with Upclass.ai. By registering, instructors confirm they are authorized to enter a binding agreement and ensure compliance with all relevant laws for the content they upload.
• Students: Students accessing content on Upclass.ai must be enrolled and authorized by the respective instructor. Unauthorized access or distribution of Upclass.ai-secured content is strictly prohibited and may lead to account termination.

4. Account Security

Instructors and students are responsible for maintaining the confidentiality of their account credentials. Sharing of login details or unauthorized access is prohibited. Upclass.ai is not liable for any damage resulting from compromised accounts due to failure to secure login information.

5. Permitted Use

• Upclass.ai grants instructors a limited, non-exclusive license to upload educational content for encryption and secure distribution.
• Students are granted access to view encrypted educational content only as authorized by their instructor.
• Unauthorized activities, including recording, copying, or sharing encrypted content, are strictly prohibited. Users violating these terms may have their access terminated without prior notice.

6. Intellectual Property Rights

All Upclass.ai platform materials, trademarks, and logos are protected by intellectual property laws. Instructors retain ownership of their content, but by uploading, they grant Upclass.ai the right to encrypt, host, and display the content to authorized users. Unauthorized use of Upclass.ai's intellectual property is prohibited and may result in legal action.

7. Fees and Payment

• Instructors: Instructors are required to pay subscription fees in advance to use Upclass.ai's services. Payments must be made within the designated period to avoid interruptions. Failure to meet payment requirements may result in suspended access until dues are cleared.
• Students: Payments made by students to instructors for access to Upclass.ai-secured content are subject to the refund policy of each respective instructor. Upclass.ai is not responsible for handling student payments or refunds.

8. Privacy and Data Protection

Upclass.ai is committed to protecting user privacy and securely handling personal data. Data collection, usage, and protection practices are detailed in our Privacy Policy. By using our services, instructors and students consent to our data handling practices in compliance with applicable laws.

9. Limitation of Liability

Upclass.ai's services are provided on an "as-is" basis. We strive for reliability but do not guarantee uninterrupted or error-free service. Upclass.ai disclaims all implied warranties and is not liable for any indirect, incidental, or consequential damages, including lost revenue, data, or content, arising from the use or inability to use our services.

10. Termination of Service

• Instructors: Instructors may terminate their Upclass.ai subscription by providing prior notice of 3 months. Any outstanding dues must be settled before account termination. Termination does not entitle instructors to a refund of fees already paid.
• Students: Students found violating terms, such as unauthorized sharing or copying of content, may have their access revoked immediately without a refund. Upclass.ai reserves the right to terminate student accounts without prior notice if terms are breached.

11. Amendments to Terms

Upclass.ai reserves the right to update or modify these terms at any time to reflect changes in laws, practices, or services. Any modifications will be posted on our website, and significant changes will be communicated via email. Continued use of Upclass.ai after updates indicates acceptance of the new terms.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of India. In the event of a dispute, it shall be resolved under the jurisdiction of the courts of Bangalore, Karnataka. Users agree to the exclusive jurisdiction of these courts for resolving disputes arising out of these terms.
